Acceptable Use Policy

Introduction

This Acceptable Use Policy (“AUP”) governs the use of all hosting services provided by Ivapix Corporation, including managed hosting panel environments, dedicated server infrastructure, and automated infrastructure services (collectively, the “Services”). This AUP applies to all customers, account holders, and any end users who access the Services through a customer account.

By activating or using any Ivapix hosting service, you confirm that you have read, understood, and agreed to comply with this AUP. You are also responsible for ensuring that any users you grant access to your account or services comply with these terms equally.
This AUP is incorporated by reference into Ivapix Corporation’s Terms of Service. Ivapix reserves the right to amend this AUP at any time. Continued use of the Services following any amendment constitutes acceptance of the revised policy. Unless otherwise defined here, all terms carry the meaning ascribed to them in the Terms of Service.

1. Lawful and Appropriate Use

All use of Ivapix’s hosting Services must be lawful, ethical, and consistent with the intended purpose of those Services. You are solely responsible for the content hosted on and the activities conducted through your account.
1.1 Illegal Activities
You may not use the Services to conduct, facilitate, or promote any activity that violates applicable local, national, or international law or regulation. This includes but is not limited to:

– Hosting, distributing, or linking to child sexual abuse material (CSAM) or any content harmful to minors. Violations will result in immediate suspension without notice and will be reported to relevant law enforcement authorities.

– Engaging in or facilitating fraud, phishing, identity theft, financial scams, or deceptive marketing practices of any kind.

– Hosting content related to pyramid schemes, Ponzi schemes, or unlicensed financial services including unregulated cryptocurrency exchanges or FOREX trading platforms.

– Distributing controlled substances, prescription medications without proper authorisation, or content promoting illegal trade.

– Facilitating human trafficking, exploitation, or the promotion or advertisement of prostitution or sex trafficking services.

– Hosting or promoting content that incites violence, terrorism, hate speech, or discrimination against individuals or groups on the basis of race, religion, ethnicity, gender, sexual orientation, disability, or any other protected characteristic.

1.2 Intellectual Property Violations
You may not use the Services to infringe upon the intellectual property rights of any third party. This includes:

– Hosting, distributing, or reproducing copyrighted material without proper authorisation, including pirated software, games, films, music, or digital content (commonly referred to as “Warez”).

– Operating mirror sites that offer unlicensed downloads of third-party software or media.

– Misappropriating trademarks, trade secrets, or other proprietary rights without permission from the rights holder.

1.3 Offensive and Harmful Content
Ivapix reserves the right to remove content that, in its reasonable assessment, is harmful, defamatory, obscene, or otherwise objectionable. Specifically prohibited content includes:

– Content that is defamatory, threatening, harassing, or abusive toward any individual or organisation.

– Explicit or pornographic content on shared and managed panel hosting environments. Such content may only be hosted on dedicated server plans where explicitly permitted under a separate written agreement with Ivapix.

– Content that misrepresents your identity, credentials, or affiliation with any person, company, or organisation.

– Content that misrepresents your identity, credentials, or affiliation with any person, company, or organisation.

2. Email and Messaging

Ivapix operates a zero-tolerance anti-spam policy. Abuse of email infrastructure is one of the most damaging actions a hosted customer can take, as it directly impacts the deliverability and IP reputation of all customers on shared infrastructure.

2.1. Anti-Spam.  You may not use the Services to send, relay, distribute, or facilitate unsolicited bulk email (spam) or other unsolicited mass communications of any nature. This includes:

– Sending email to purchased, scraped, harvested, or non-opted-in mailing lists.

– Forging, spoofing, or misrepresenting email headers, sender identities, or originating IP addresses.

– Operating or configuring open mail relays on Ivapix infrastructure.

– Any account whose associated IP address is listed on a recognised spam blacklist or abuse database as a result of the customer’s actions will be subject to immediate investigation and may be suspended until the matter is resolved.

2.2 Email from WordPress Where your WordPress environment is configured to send email — including transactional email, WooCommerce notifications, or contact form submissions — you are responsible for ensuring those emails comply with all applicable anti-spam laws. Customers requiring high-volume or bulk email delivery must use a dedicated third-party transactional email service and may not rely solely on WordPress’s native mail functions for this purpose.

2.3 Hosting Panel Communication Tools
Any communication features or tools available within the Ivapix hosting panel may only be used for legitimate support and account management purposes. They may not be used to promote third-party products, services, or commercial opportunities unrelated to your hosted account.

3. Security and System Integrity

The security and integrity of Ivapix’s infrastructure, and the systems of other customers and third parties, must not be compromised. The following activities are strictly prohibited:

3.1 Unauthorized Access
You may not use the Services to attempt to gain unauthorised access to any system, network, database, or device whether belonging to Ivapix, another customer, or any third party. This includes:

– Probing, scanning, or testing systems for vulnerabilities without explicit written authorisation from the system owner.

– Exploiting known vulnerabilities in software, applications, or network configurations.

– Attempting to bypass authentication mechanisms, firewalls, or access controls on any system.

3.2 Malicious Code and Software
You may not host, distribute, or execute code or software designed to cause harm. Prohibited items include viruses, worms, Trojan horses, ransomware, rootkits, keyloggers, spyware, and any other form of malware or destructive code. All WordPress installations, plugins, themes, and custom code hosted on Ivapix infrastructure must be free from known security vulnerabilities. It is your responsibility to keep all installed software updated with current security patches in a timely manner.

WordPress environments: This obligation applies to all WordPress core files, plugins, and themes. These are frequent targets for exploitation due to their widespread use. Ivapix may disable or remove insecure software at any time without prior notice if it poses a risk to the platform or other customers.

3.3 Traffic Interception Monitoring, capturing, or intercepting data or network traffic on Ivapix infrastructure without Ivapix’s explicit authorisation is prohibited. This includes packet sniffing, session hijacking, and man-in-the-middle activities.

3.4 Denial of Service Activities
You may not use the Services to launch, coordinate, facilitate, or participate in any Denial of Service (DoS) or Distributed Denial of Service (DDoS) attack against any target, including Ivapix’s own infrastructure or third-party systems. Ivapix’s hosting services may not be used to offer or operate DoS/DDoS mitigation as a service, as such configurations present unacceptable risk to shared infrastructure.

4. Resource Use

Responsible use of hosting resources is essential to maintain consistent performance across all customer environments. Because Ivapix provides dedicated WordPress hosting through Automattic’s managed infrastructure, direct server-level access is not available to customers. Resource management at the infrastructure level is handled by Automattic. However, customers remain responsible for how their WordPress installation consumes the resources allocated to their plan.

4.1 WordPress Resource Consumption
You may not deliberately or negligently configure your WordPress environment in a way that causes excessive or unreasonable resource consumption. This includes but is not limited to:

– Installing or running resource-intensive plugins that generate sustained abnormal CPU or memory load without a legitimate operational justification.

– Running poorly optimised database queries, excessive API calls, or unoptimised scripts that degrade the performance of your hosted environment.

– Uploading and serving extremely large media files without appropriate optimisation where such usage significantly and consistently strains allocated resources.

4.2 WP-Cron Usage
Because Ivapix’s hosting is delivered through Automattic’s managed WordPress infrastructure, customers do not have access to server-level cron jobs. Scheduled tasks within WordPress are handled through WordPress’s built-in scheduling system (WP-Cron). You are responsible for using WP-Cron responsibly. Prohibited uses include:

– Configuring scheduled tasks to run at frequencies that are excessive or unnecessary for the function being performed.

– Using WP-Cron to trigger resource-heavy processes repeatedly in a manner that degrades the performance of your hosting environment.

– Attempting to abuse WP-Cron as a mechanism to circumvent other restrictions in this AUP.

4.3 Cryptocurrency Mining
Mining of any cryptocurrency — whether individually, collectively, or as part of a cloud-based mining operation — is strictly prohibited on all Ivapix hosting plans.

4.4 Disk Space and Storage
Your hosting allocation is provided for the purpose of operating your WordPress website and its associated content. It may not be used primarily as a general-purpose file storage solution, personal data archive, or media repository unrelated to your hosted site. Ivapix reserves the right to request removal of such content after providing reasonable notice.

5. WordPress Software and Plugin Responsibility 

All WordPress plugins, themes, and custom code installed within your hosting environment are your responsibility. Ivapix provides and manages the underlying dedicated infrastructure but does not audit individual application code. The following requirements apply to all customer accounts:

– All WordPress core installations, plugins, and themes must be kept updated with current releases and security patches in a timely manner.

– Plugins or themes with documented, unpatched vulnerabilities must not remain active on your site.

– You may not install plugins or code that is designed to interfere with, monitor, or compromise other systems, websites, or users.

– You may not use your WordPress environment to operate services or software that would otherwise be prohibited under this AUP, such as proxies, scrapers, or automated attack tools, regardless of whether they are implemented via a plugin or custom code.

6. Privacy and Personal Data

You are responsible for ensuring that any personal data you collect, process, or store through your hosted services complies with all applicable privacy and data protection laws, including but not limited to the General Data Protection Regulation (GDPR), the Protection of Personal Information Act (POPIA), and any other regulations applicable to your jurisdiction and customer base.

6.1 Data Collection and Harvesting
You may not use Ivapix infrastructure to harvest, collect, or compile personal information, email addresses, or other personal identifiers from third parties without their informed consent. This includes phishing, scraping, spidering, social engineering, and any other method of obtaining personal data without proper authorisation.

6.2 Sensitive Personal Information
You may not store sensitive personal information — such as health records, financial account credentials, identity document numbers, or authentication data — without implementing appropriate technical and organisational security measures. Customers with specialised compliance requirements (such as HIPAA) must contact Ivapix to discuss applicable dedicated infrastructure arrangements before storing such data.

6.3 Impersonation and False Identity
You may not create accounts, deploy websites, or send communications that falsely represent the identity of another individual, business, or organisation, for any purpose.

7. Monitoring and Enforcement

Ivapix reserves the right, but does not assume the obligation, to monitor hosted content and account activity for compliance with this AUP. Where a violation is identified or reasonably suspected, Ivapix may, at its sole discretion, take any of the following actions:

– Issue a formal warning and require corrective action within a specified timeframe.

– Suspend access to the affected account or specific services, with or without prior notice, pending investigation or resolution.

– Permanently terminate the account and all associated services in cases of serious, repeated, or unresolved violations.

– Remove, disable, or restrict access to specific content, files, databases, or services within a hosted account.

– Report violations to relevant law enforcement authorities, regulatory bodies, or industry abuse registries where Ivapix is obligated or reasonably considers it appropriate to do so.

Ivapix cooperates with law enforcement agencies and regulatory authorities and may disclose account information in response to lawful requests. Where Ivapix’s infrastructure is adversely affected as a result of a customer’s actions — including being subjected to a DDoS attack, IP blacklisting, or legal complaint — Ivapix reserves the right to take immediate protective action without prior notice.

Please note: Failure to respond to a communication from Ivapix’s support or compliance team within 48 hours of the specified deadline may result in the suspension or termination of your account.

8. Customer Responsibilities

You are fully responsible for:

– All activities conducted through your account, whether initiated by you or by any third party to whom you have granted access.

– Ensuring that your end users, clients, and any sub-accounts comply with this AUP.

– Maintaining the security of your account credentials and promptly notifying Ivapix of any suspected unauthorised access.

– Complying with all laws and regulations applicable to your jurisdiction and industry, including data protection, consumer protection, and advertising standards.

Ivapix does not review or endorse the content hosted by its customers and accepts no liability for any content, activity, or consequence arising from a customer’s use of the Services. Customers operating reseller or white-label hosting arrangements are responsible for ensuring their own customers comply with this AUP.

9. Amendments

Ivapix Corporation may update or modify this AUP at any time. Where changes are material, Ivapix will endeavour to provide reasonable advance notice via email or a notice posted within the hosting panel. Continued use of the Services following the effective date of any update constitutes acceptance of the revised AUP. It is your responsibility to review this policy periodically.

11. Governing Law and Jurisdiction

This AUP and any dispute arising out of or in connection with it shall be governed by the laws of the State of Delaware, United States of America, and the applicable federal laws of the United States. Any disputes that cannot be resolved through Ivapix’s standard support channels shall be subject to the jurisdiction of the courts of the State of Delaware.

Should any provision of this AUP be found to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.
